By creating an account or using ScoreUp, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our service. If you are using ScoreUp on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
ScoreUp is a basketball statistics platform designed for high school basketball programs. The service allows coaches, administrators, and authorized users to record game statistics, track player performance, generate analytics and leaderboards, and produce AI-powered scouting reports.
You must be at least 18 years of age to create an account on ScoreUp. By creating an account, you represent and warrant that you are at least 18 years old. Minors (including high school players) do not create accounts — their game statistics are entered by authorized adult coaches and administrators.

Each organization may have only one administrative account. Additional users may be invited by the administrator through the platform's access management features.

If you use ScoreUp on behalf of an educational institution, you represent that you are authorized by the institution to enter student-athlete data into the platform. You acknowledge that student data may be subject to the Family Educational Rights and Privacy Act (FERPA) and other applicable student privacy laws. By entering student data, you confirm that your institution has authorized the use of ScoreUp as a "school official" with a legitimate educational interest, or that the data qualifies as "directory information" under your institution's FERPA policy. The ScoreUp platform, including its design, code, logos, and documentation, is owned by ScoreUp and protected by intellectual property laws. You retain full ownership of the game data and statistics you enter into the platform. By using ScoreUp, you grant us a non-exclusive, royalty-free, limited license to use this data solely for the purpose of providing, maintaining, and improving our services. We will not use your data for any purpose unrelated to the ScoreUp platform.
ScoreUp offers AI-powered scouting reports and analytics generated using artificial intelligence. This content is provided for informational purposes only and should not be considered professional coaching advice, recruiting recommendations, or a substitute for professional judgment. AI-generated reports may contain inaccuracies or errors. You acknowledge that you use AI-generated content at your own discretion and risk.
ScoreUp is provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure at all times.
To the maximum extent permitted by law, ScoreUp and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising out of or related to your use of the service. Our total liability for any claim arising from these terms or the service shall not exceed the amount you paid us in the twelve months preceding the claim.
You agree to indemnify, defend, and hold harmless ScoreUp and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the service, your violation of these Terms, or your violation of any applicable law or regulation, including but not limited to student privacy laws such as FERPA.
We may suspend or terminate your access to ScoreUp at any time if you violate these Terms of Service or for any other reason at our sole discretion. You may also delete your account at any time. Upon termination, your right to use the service ceases immediately. Your data will be handled in accordance with our Privacy Policy, including the data retention periods described therein. Provisions that by their nature should survive termination (including Intellectual Property, Indemnification, Limitation of Liability, Governing Law, and Entire Agreement) will remain in effect.
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these terms or the service shall be resolved exclusively in the state or federal courts located in the State of Texas, and you consent to the personal jurisdiction of such courts.
You agree to use ScoreUp in compliance with all applicable federal, state, and local laws and regulations, including but not limited to FERPA, COPPA, TDPSA, CCPA, and GDPR where applicable. If you are using ScoreUp on behalf of an educational institution, you are responsible for ensuring that your use complies with your institution's policies and applicable student privacy laws.
We may update these Terms of Service from time to time. We will notify you of any material changes by posting the updated terms on this page and updating the "Last updated" date. For material changes that affect your rights, we will make reasonable efforts to notify registered users via email. Your continued use of ScoreUp after changes are posted constitutes your acceptance of the revised terms.
ScoreUp shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, cyberattacks, pandemics, or third-party service provider failures.
If any provision of these Terms of Service is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
These Terms of Service, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ScoreUp regarding your use of the service and supersede any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
